Terms & Conditions

Zudocode (Pty) Ltd strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Zudocode Networks customers and us against such harm. Zudocode reserves the right to update this policy at any time, so please check back periodically.

Payment Policies
Full payment is required before any hosting service is rendered, which includes renewals. All payment-due notices will be sent by electronic mail. Payment is due on the first day of the month, for that month. New orders are pro-rata to the first day of the month. All customers will receive invoices 15 days before the due date. Billing will continue until you cancel your hosting account. We accept the following forms of payment: Electronic Funds Transfer (EFT), Credit Card (MasterCard and Visa), PayPal, PayFast and Debit Order.

Debit orders that return as unpaid will attract a R50 administration fee. The account should then be settled by EFT or Credit Card, no further debit orders will run on the account until the overdue amount has been settled.

Late Payment
It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree that until and unless you notify Zudocode of your desire to cancel any or all services received (by the proper means listed in the appropriate section of the Terms & Conditions), those services will be billed on a recurring basis, unless otherwise stated in writing by Zudocode. Zudocode reserves the right to allocate payments to the oldest outstanding invoice on your account. Zudocode reserves the right to bill your credit card or billing information on file with us.

Zudocode provides a 10 day grace period from the time the invoice is due and when it must be paid. Any invoice that is overdue for 10 days will result in account and service suspension until account balance has been paid in full. Access to the account will not be restored until all outstanding payments have been received. We do not charge a reactivation fee.

Non-payment of outstanding service fee invoices will result in termination of the hosting service. There is no guarantee that a backup will be available.


Cancellation
Cancellations must be done via support@zudocode.co.za. You have the option of cancelling your account immediately or at the end of the billing period. If you choose to cancel the account immediately then your account will be terminated from our servers on receipt of the cancellation. Cancellation of a subscription does not cancel any outstanding invoices. All outstanding invoices are still due.

Domain Services
We use the services of a third-party registrar to register domains. The registration is subject to the terms of the relevant registrar. Registration, maintenance, or transfer of a domain name is subject to the terms of the relevant registry governing the domain name.

When registering a domain name, it is not your property, it cannot be "owned" by anyone. We will register the domain in the name of the "Registrant" and they will have full control of the domain. We cannot guarantee the registration of a domain name, we will make every effort to register the domain that you choose.

We will not be held responsible if you give us incomplete or inaccurate information that will lead to a delay in the registration process. If you are acting on behalf of the domain owner, you agree to register the domain in your customers name. It is important to ensure that the correct person or entity is disclosed as the registrant. All registrant details must be true and accurate, you are not allowed to prevent a domain owner from moving their domain away should they choose to do so.

We will only act on instructions of the account holder or other authorised users on the account. We act on your instructions to the extent that those instructions are possible and lawful.

All domain registrations are final. Domain names cannot be modified once they have been registered, a new domain will need to be registered.

You warrant that:

⚬ All information provided in the registration of the domain is complete and accurate.
⚬ You are entitled to register the domain name.
⚬ If you are not the domain owner, that you have permissions from the owner to act on their behalf.
⚬ You are not breaking any law or violating any Intellectual Property Rights by registering this domain.
⚬ The domain will not be used in a malicious way.


We will do our utmost to prevent expiry of your domain name, it remains your responsibility to ensure that the domain does not expire. Our billing system has been programmed to automatically generate your domain renewal invoice unless you expressly tell us not to do so, in which case the domain will expire. We try and send reminders before expiry dates. It may occur that reminders are not sent due to events beyond our control, we will not be held liable.

You indemnify us against any loss or damage that we may suffer arising from registration of your domain name.

Domain Cost Refund Policy
Please note that fees payable for domain registration and renewal costs are non-refundable. Zudocode accepts no responsibility for any typing errors (spelling mistakes) you make when ordering a domain name with us. Once a domain name has passed its expiry date there is no guarantee that we are able to renew the domain, additional charges might apply in these cases.

Premium Domains
As various registries worldwide mark high value domains as premium domains, these domains cost more. We will make every effort to apply pricing of a premium domain prior to checkout however this may not always be possible. Should the Customer have paid for domain which is a premium domain / marked / reflected as premium, the Customer will be given the opportunity to pay the premium domain name fee or a refund of the price paid will be given to the customer.

Unlimited Traffic/Storage Policy
Our unlimited plans do not have set limits on bandwidth and disk storage. Instead, we have a fair use policy which goes as follows.

Bandwidth and disk storage are unlimited as long as:

⚬ they used as an integral part of your website,
⚬ you are not intentionally abusing the service by using excessive bandwidth or disk storage,
⚬ you are not violating our terms and conditions, and
⚬ you are not impeding our capability to provide other service to other customers.

Email storage under Unlimited packages is subject to the following:

⚬ we do not allow long term storage of emails, we reserve the right to remove emails older than 12 months,
⚬ we do not allow the use of unattended mailboxes, if an account has unread emails older than 180 days it will be considered abandoned and may be deleted,
⚬ emails stored in 'spam' or 'deleted' folders may be deleted where such email are over 30 days old.
In other words, if you are adding content (images, files, text etc) to your site and using the service in the way it is intended to be used, then we will not limit the amount of bandwidth and disk storage your site is consuming.

Our intention is that, as long as both parties are being fair, you should not have to worry about bandwidth or disk storage limits. We'll take care of these sorts of issues so you can concentrate on growing your site.

If, however, you are attempting to take advantage of the service by distributing or storing large files, PDF's or images, streaming excessive video or hosting music or something similar, then we will request that you cease doing so.

SPAM Policy
Zudocode takes a zero-tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of Zudocode may not use or permit others to use our network to transact in UCE. Customers of Zudocode may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.

If your actions have caused Zudocode's mail servers or Zudocode's IP address ranges to be placed on blacklists and other mail filtering software systems used by companies on the Internet, you will be assessed a R500 charge to your account for administrative charges incurred to remove and protect mail servers and IP ranges.

Content Policy
All services provided by Zudocode are to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any South African, United Kingdom or United States Federal, State, Provincial or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Zudocode from any claims resulting from the use of the service which damages the subscriber or any other party.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Zudocode's servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

⚬ Pirated software
⚬ Hacker programs or archives
⚬ Fraudulent activities
⚬ Adult sites
⚬ Spellcaster sites
⚬ Warez sites

Any illegal activity, online gambling, spamming or hacking will result in your site being shut down. The customer is solely responsible for the content stored on and served on their hosting space.

Zudocode will be the sole arbiter as to what constitutes a violation of this provision.

Scripts and Software Policy
You are free to install and use any scripts you wish, (as long as they are not on our banned scripts list, see below) however we reserve the right to disable any script or software in your hosting account that affects normal server operation or service to other Zudocode customers.

Zudocode is not responsible for scripts that you use in your hosting. It is not our responsibility to ensure your scripts function correctly. Please don’t expect our support techs to troubleshoot aspects of your scripts or third-party scripts that you use on your sites hosted on our servers.

Zudocode provides technical support for the server & server related softwares. Any scripts included in the Softaculous are 3rd party scripts and support is not provided by our techs.

The following scripts are banned due to the potential harm they can cause to other sites on the same server:

⚬ AlienForm (all versions)
⚬ formmail.pl
⚬ Greymatter (all versions)
⚬ Open Webmail
⚬ Ikonboard (all versions)
⚬ IRC Egg Drops & IRC related programs.

⚬ Proxy Servers & Scripts (EX: nph-proxy)
⚬ Shell, SSH, Telnet Scripts and Shell, SSH, Telnet Alternatives (cgitelnet.pl)
⚬ The Anonymizer
⚬ UltimateBBS (all versions)
⚬ YABB + YABB se (all versions)
⚬ Any script that uses / processes a massive number of flatfiles or large flatfile databases.
⚬ Crypto currency mining software, crypto currency wallets and crypto currency related websites.



Resource Usage
Our hosting accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs server/network performance is prohibited by this policy and may result in suspension of your account without notice. You are prohibited from excessive consumption of resources, including processing time, memory and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of Zudocode's systems or Hosting. Zudocode reserves the right to terminate or limit such activities.

System and Network Security
Users are prohibited from violating or attempting to violate the security of the Zudocode Network. Violations of system or network security may result in civil or criminal liability. Zudocode will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:

Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.

Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing". Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Taking any action in order to obtain services to which such user is not entitled.

Backups
Full backups are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client’s responsibility to maintain local copies of their web content and information.

Intellectual Property
We are the owner and/or authorised user of all trademarks, service marks, design marks, patents, copyrights, database rights and all other intellectual property appearing on or contained within the Site, unless otherwise indicated. Except as provided in these Terms & Conditions, use of the Site does not grant you any right, title, interest or license to any such intellectual property you may access on the Site. Except as provided in these Terms & Conditions, any use or reproduction of the intellectual property is prohibited.

You may view this Site and you are welcome to print hard copies of material on it solely for your lawful, personal, non-commercial use. All other copying, whether in electronic, hard copy or other format, is prohibited and may breach intellectual property laws and other laws world-wide. Furthermore, you are not entitled to reproduce, transmit, publicly perform, distribute, adapt, translate, modify, bundle, merge, share or make available to any person, or create derivative works of such material, or use it for commercial purposes, without our prior written consent. All other rights are reserved.

Refusal of Service
We reserve the right to refuse service to anyone for any reason not prohibited by law. We reserve the right to terminate service to any customer for any reason not prohibited by law.

Any deliberate attempt to cause damage to Zudocode’s servers, the Zudocode network or any other internet servers will result in immediate account deactivation without prior notice

General Notice
Thank you for reading Zudocode (Pty) Ltd's Acceptable Use Policy (AUP). By accessing this website, or by contracting with us for service, you agree, without limitation or qualification, to be bound by this policy and the terms and conditions it contains, as well as any other additional terms, conditions, rules or policies which are displayed to you in connection with this service/website.

The purpose of this AUP is to comply with the relevant laws of the Republic; to specify to customers and users of our service/website what activities and online behaviour are considered an unacceptable use of the service/website; to protect the integrity of our network and to specify the consequences that may flow from undertaking such prohibited activities.

This document contains a number of legal obligations which you are presumed to be familiar with. As such, we encourage you to read this document thoroughly and direct any queries to support@zudocode.co.za

Zudocode (Pty) Ltd respects the rights of our customers and users of our services to freedom of speech and expression; access to information; privacy; human dignity; religion, belief and opinion in accordance with our constitution. We undertake not to interfere with any of those rights unless required to do so by law; unless those rights are exercised for unlawful purposes; or unless the exercise of those rights threatens to cause harm to another person or affect the integrity of our network

ISPA membership and Code of Conduct
Zudocode(Pty) Ltd confirms that in compliance with section 72 of the Electronic Communications and Transactions Act 25 of 2002, Zudocode(Pty) Ltd is a member of the Internet Service Providers' Association (ISPA) and has adopted and implemented the association's official Code of Conduct, which can be viewed at http://www.ispa.org.za/code..

Unlawful Use
Zudocode(Pty) Ltd's services may only be used for lawful purposes and activities. We prohibit any use of our website/network including the transmission, storage and distribution of any material or content using our network that violates any law or regulation of the Republic. This includes:

- Any violation of local and international laws prohibiting child pornography; obscenity; discrimination (including racial, gender or religious slurs) and hate speech; or speech designed to incite violence or hatred, or threats to cause bodily harm.
- Any activity designed to defame, abuse, stalk, harass or physically threaten any individual in the Republic or beyond its borders; including any attempt to link to, post, transmit or otherwise distribute any inappropriate or defamatory material.
- Any violation of Intellectual Property laws including materials protected by local and international copyright, trademarks and trade secrets. Moreover Zudocode(Pty) Ltd cannot be held liable if you make any unlawful use of any multimedia content accessed through the search facility provided by Zudocode(Pty) Ltd's network, or otherwise available through access to our network, whether for commercial or noncommercial purposes.
- Any violation of the individual's right to privacy, including any effort to collect personal data of third parties without their consent.
- Any fraudulent activity whatsoever, including dubious financial practices, such as pyramid schemes; the impersonation of another subscriber without their consent; or any attempt to enter into a transaction with Zudocode(Pty) Ltd on behalf of another subscriber without their consent.
- Any violation of the exchange control laws of the Republic.
- Any activity that results in the sale, transmission or distribution of pirated or illegal software.
- Failing to respond to a request by a recipient of unsolicited mail to be removed from any mailing or direct marketing list and continuing to send unsolicited mail following such a request for removal.

Where any user resides outside of the Republic, permanently or temporarily, such user will be subject to the laws of the country in which s/he is currently resident and which apply. On presentation of a legal order to do so, or under obligation through an order for mutual foreign legal assistance, Zudocode(Pty) Ltd will assist foreign law enforcement agencies (LEA) in the investigation and prosecution of a crime committed using Zudocode(Pty) Ltd's resources, including the provisioning of all personal identifiable data.

Prohibited Activities
The following sections outline activities that are considered an unacceptable use of Zudocode(Pty) Ltd's services/network/website and also detail the guidelines for acceptable use of certain facilities/services, as the case may be.

Threats to Network Security

Any activity which threatens the functioning, security and/or integrity of Zudocode(Pty) Ltd's network is unacceptable. This includes:

- Any efforts to attempt to gain unlawful and unauthorised access to the network or circumvent any of the security measures established by Zudocode(Pty) Ltd for this goal;
- Any effort to use Zudocode(Pty) Ltd's equipment to circumvent the user authentication or security of any host, network or account ("cracking" or "hacking");
- Forging of any TCP-IP packet header (spoofing) or any part of the header information in an email or a newsgroup posting;
- Any effort to breach or attempt to breach the security of another user or attempt to gain access to any other person's computer, software, or data without the knowledge and consent of such person;
- Any activity which threatens to disrupt the service offered by Zudocode(Pty) Ltd through "denial of service attacks";
flooding of a network, or overloading a service or any unauthorised probes ("scanning" or "nuking") of others' networks;
- Any activity which in any way threatens the security of the network by knowingly posting, transmitting, linking to or otherwise distributing any information or software which contains a virus; Trojan horse; worm, lock, mail bomb, cancelbot or other harmful, destructive or disruptive component.
- Any unauthorised monitoring of data or traffic on the network without Zudocode(Pty) Ltd's explicit, written consent.
- Any unsolicited mass mailing activity including direct marketing; spam and chain letters for commercial or other purposes, without the consent of the recipients of those mails.

Public Space and Third Party Content and sites
In reading this AUP or in signing a service contract with Zudocode(Pty) Ltd, you acknowledge that Zudocode(Pty) Ltd has no power to control the content of the information passing over the Internet and its applications, including e-mail; chat rooms; news groups; or other similar fora, and that Zudocode(Pty) Ltd cannot be held responsible or liable, directly or indirectly, for any of the abovementioned content, in any way for any loss or damage of any kind incurred as a result of, or in connection with your use of, or reliance on, any such content.

Our services also offer access to numerous third party webpages. You acknowledge that we exercise absolutely no control over such third party content, or sites and in such cases, our network is merely a conduit or means of access and transmission. This includes, but is not limited to, third party content contained on or accessible through the Zudocode(Pty) Ltd network websites and web pages or sites displayed as search results or contained within a directory of links on the Zudocode(Pty) Ltd network. It remains your responsibility to review and evaluate any such content, and that any and all risk associated with the use of, or reliance on, such content rests with you.

Access to public Internet spaces, such as bulletin boards, Usenet groups, chat rooms and moderated forums is entirely voluntary and at your own risk..

Zudocode(Pty) Ltd employees do not moderate any of these services, or your communications, transmissions or use of these services. We do not undertake any responsibility for any content contained therein, or for any breaches of your right to privacy that you may experience as a result of accessing such spaces.

Unsolicited, Spam and Junk mail
Spam and unsolicited bulk mail are highly problematic practices. They affect the use and enjoyment of services by others and often compromise network security. Zudocode(Pty) Ltd will take swift and firm action against any user engaging in any of the following unacceptable practices:

- Sending unsolicited bulk mail for marketing or any other purposes (political, religious or commercial) to people who have not consented to receiving such mail;
- Operating or maintaining mailing lists without the express permission of all recipients listed;
- Failing to promptly remove from lists invalid or undeliverable addresses or addresses of unwilling recipients or a recipient who has indicated s/he wishes to be removed from such list;
- Using Zudocode(Pty) Ltd's service to collect responses from unsolicited e-mail sent from accounts on other Internet hosts or e-mail services, that violate this AUP or the AUP of any other Internet service provider;
- Including Zudocode(Pty) Ltd's name in the header or by listing an IP address that belongs to Zudocode(Pty) Ltd in any unsolicited email whether sent through Zudocode(Pty) Ltd's network or not;
- Failure to secure a customer's mail server against public relay as a protection to themselves and the broader Internet community. Public relay occurs when a mail server is accessed by a third party from another domain and utilised to deliver mails, without the authority or consent of the owner of the mail-server. Mail servers that are unsecured against public relay often become abused by unscrupulous operators for spam delivery and upon detection such delivery must be disallowed. Zudocode(Pty) Ltd reserves the right to examine users' mail servers to confirm that no mails are being sent from the mail server through public relay and the results of such checks can be made available to the user. Zudocode(Pty) Ltd also reserves the right to examine the mail servers of any users using Zudocode(Pty) Ltd's mail servers for "smarthosting" (when the user relays its mail via a Zudocode(Pty) Ltd mail server to a mail server of its own or vica-versa) or similar services at any time to ensure that the servers are properly secured against public relay. All relay checks will be done in strict accordance with Zudocode(Pty) Ltd's privacy policy.

Spam/virus Filtering
Zudocode(Pty) Ltd provides a spam and virus filtering system to protect customers from unsolicited mail and viruses. The customer acknowledges that this system might incorrectly identify a valid message as spam or as a virus and consequently this message might not be delivered to the customer. The customer acknowledges and agrees that Zudocode(Pty) Ltd shall without limitation have no responsibility for, or liability in respect of any data lost as a result of this system.

Zudocode(Pty) Ltd reserves the right to examine incoming or outgoing mail to the extent necessary to determine if it is classified as spam.

Webmail
Webmail and other web based email services made available by Zudocode(Pty) Ltd are provided on an "as is" basis without representations, warranties or conditions of any kind, and the customer acknowledges and agrees that Zudocode(Pty) Ltd shall have no responsibility for, or liability in respect of, any aspect of the Webmail services, including without limitation for any lost or damaged data or any acts or omissions of Zudocode(Pty) Ltd. As webmail storage space is limited, some Webmail messages may not be processed due to space constraints or message limitations.

Webmail is provided to individuals and for personal use only. Any unauthorised commercial use of the Webmail service, or resale of the Webmail service is expressly prohibited.

Shared Hosting
Eitehost's shared accounts operate on shared resources. hared Hosting is designed for serving personal hosting requirements or that of small enterprises, and not medium to large enterprises or high traffic websites. In such cases we will recommend an upgrade to dedicated resources offered by a virtual server product. Clients will be given notice as such, and will be informed of any cost implications. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs server/network performance is prohibited by this policy and may result in suspension of your account without notice. You are prohibited from excessive consumption of resources, including processing time, memory and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of Zudocode's systems or Hosting. Zudocode reserves the right to terminate or limit such activities.

Protection of Minors
Zudocode(Pty) Ltd prohibits customers from using Zudocode(Pty) Ltd's service to harm or attempt to harm a minor, including, but not limited to, by hosting, possessing, disseminating, distributing or transmitting material that is unlawful, including child pornography.

Privacy and Confidentiality
Zudocode(Pty) Ltd respects the privacy and confidentiality of our customers and users of our service. Please review our privacy policy which details how we collect and use personal information gathered in the course of operating this service.

User Responsibilities
Customers are responsible for any misuse of Zudocode(Pty) Ltd's services that occurs through the customer's account. It is the customer's responsibility to ensure that unauthorised persons do not gain access to or misuse Zudocode(Pty) Ltd's service.

Zudocode(Pty) Ltd urges customers not to reply to unsolicited mail or "spam", not to click on any suggested links provided in the unsolicited mail. Doing so remains the sole responsibility of the customer and Zudocode(Pty) Ltd cannot be held liable for the Customer being placed on any bulk mailing lists as a result.

Where the customer has authorised a minor to use any of the Zudocode(Pty) Ltd's services or access its websites, you accept that as the parent/legal guardian of that minor, you are fully responsible for: the online conduct of such minor; controlling the minor's access to and use of any services or websites; and the consequences of any misuse by the minor, including but not limited to transactions entered into by the minor using such access.

Zudocode(Pty) Ltd cannot be held liable for any business dealings you have with any third parties on the Internet, including any vendors, or advertisers found on, or through, the Zudocode(Pty) Ltd network. Further, Zudocode(Pty) Ltd assumes no responsibility whatsoever for any charges you or any user of your account incurs when making purchases or other transactions in this manner. Further, the responsibility for ensuring compliance with all applicable customs and exchange control laws in connection with any such transactions shall be the customer's.

Notice and Take-down Procedures
Zudocode(Pty) Ltd confirms that it has a procedure in place for the notice and take-down of illegal material. In compliance with section 77 of the Electronic Communications and Transactions Act (No. 25 of 2002) Zudocode(Pty) Ltd's designated agent for this process is the Internet Service Providers’ Association. ISPA can be reached at 010 500 1200 or takedown@ispa.org.za. The notice and take-down procedure can be viewed at http://www.ispa.org.za/code.

Customers are also notified of the content and procedures of the ISPA Code of Conduct which may be used against any Internet service provider who fails to comply with the code of conduct. We urge you to familiarise yourselves with this code.

Complaints and procedures
It is the customer's responsibility to familiarise himself or herself with the procedure set out below and report any cases of violation of this AUP to Zudocode(Pty) Ltd's designated complaints handling agent.

Please note that Zudocode(Pty) Ltd cannot handle complaints concerning networks or users that do not have service contracts with us or our affiliates, or are outside of our control.

In order for Zudocode(Pty) Ltd to thoroughly investigate the complaint and take appropriate action, all complaints must be in writing, via fax or e-mail and contain as much information as possible, including, but not limited to:

- the origin of abuse or offence, including the website, full mail headers, relevant logfile extracts etc;
- any contact details for the source of the complaint;
- a brief explanation why the incident is considered to be an offence.

Zudocode(Pty) Ltd discourages anonymous complaints being made via this service, and urges complainants to supply their name and contact details to us. Such information will not be released, except where required by law enforcement. Anonymous complaints will however be acted upon as long as sufficient detail as outlined above is supplied.

Action following breach of the AUP

Upon receipt of a complaint, or having become aware of an incident, Zudocode(Pty) Ltd may take any of the following steps:

- In the case of a network, inform the user's network administrator of the incident and request the network administrator or network owner to deal address the incident in terms of this AUP and the ISPA Code of Conduct;
- In severe cases suspend access of the user's entire network until abuse can be prevented by appropriate means;
- In the case of individual users, warn the user; suspend the user's account and/or revoke or cancel the user's network access privileges completely;
- In all cases, charge the offending parties for administrative costs as well as for machine and human time lost due to the incident;
- Assist other networks or website administrators in investigating credible suspicions of any activity listed in this AUP;
- Institute civil or criminal proceedings;
- Share information concerning the incident with other Internet access providers, or publish the information, and/or make available the users' details to law enforcement agencies

Reservation and Non Waiver of Rights
Zudocode(Pty) Ltd reserves the right to amend or alter this policy at any time, and without notice to you.

Zudocode(Pty) Ltd reserves the right to take action against any individuals, companies or organizations that violate any of the prohibited activities set out herein, or engage in any illegal or unlawful activity while accessing our services, to the fullest extent of the law.

Zudocode(Pty) Ltd reserves the right, at its sole discretion, to act against other types of abuse not listed in this document and to investigate or prevent illegal activities being committed over our network.

Zudocode(Pty) Ltd reserves the right to monitor user and network traffic for site security purposes and prevent any unauthorised attempts to tamper with our site or cause damage to our property.

Zudocode(Pty) Ltd reserves the right to suspend, revoke or cancel Zudocode(Pty) Ltd's services to the customer/user if the safety and integrity of Zudocode(Pty) Ltd's resources are placed at risk in continuing to provide service to the subscriber/user.

Zudocode(Pty) Ltd reserves the right to remove any information or materials in whole or in part, that, in Zudocode(Pty) Ltd's sole discretion, is deemed to be offensive, indecent, or otherwise objectionable.

Zudocode(Pty) Ltd does not undertake to guarantee the security of any data passing through its networks. Although Zudocode(Pty) Ltd will provide a "best effort" service, including regular updates on computer viruses and other threats to security of data, it is the responsibility of the communicating parties to safeguard their data, and Zudocode(Pty) Ltd cannot be held liable for any loss or damage arising as result of the failure to do so.

Zudocode(Pty) Ltd does not waive its right to enforcement of this AUP at any time, or prejudice its right to take subsequent action, should Zudocode(Pty) Ltd fail, neglect or elect not to enforce a breach of the AUP at any time.
